Bringing vapes into Mexico could result in confiscation and fines. Mexico has implemented a nationwide ban on the importation, sale, distribution, promotion, and even personal possession of vapes and related products. Customs agents at airports are known to confiscate both disposable and reusable devices upon entry. Although enforcement may vary by region, travelers entering with a vape risk having their device taken away or even facing fines.  

This crackdown follows a 2022 presidential decree and subsequent constitutional reforms in 2024 which placed vapes in the same legal category as highly controlled substances such as fentanyl. Even though this comparison has stirred controversy, the message is clear: vaping products are not welcome in Mexico.

Is Vaping allowed in Mexico?

The use of vapes in Mexico exists in a legal grey area. Technically, vaping in private spaces is not explicitly banned, but public use is off-limits and can result in fines or the confiscation of your device. In tourist areas or private resorts, enforcement may be more relaxed, but you’re still taking a risk.  

Law enforcement primarily focuses on the possession and public use of these devices. If caught vaping in a non-smoking zone, you could be fined, but in most cases, the device will simply be confiscated. Carrying multiple devices could imply intent to distribute and might lead to more serious consequences.  

Bottom line: Even if you manage to bring a vape into Mexico, using it publicly could lead to legal trouble.  

Are You Allowed to Buy Vapes in Mexico?  

No, purchasing vapes in Mexico is illegal.  

Since October 2022, the sale and distribution of vapes—whether they contain nicotine or not—has been banned across the country. Although some individual retailers have fought the ban in court and won permissions to sell, these temporary exceptions are rare and apply only to the specific plaintiffs involved.  

As of now, the vast majority of vape products remain illegal to buy or sell. Tourists should avoid seeking out underground or “gray market” vendors, as these operations are not only illegal but often targeted by police crackdowns. 

What About Vaporizers?  

Unfortunately, the laws do not clearly distinguish between different types of vaporizers. If it resembles a vape or e-cigarette in form or function, it’s likely subject to the same restrictions. Authorities have broad discretion in law enforcement and may treat all vaping devices as illegal, regardless of what substance they are intended to be used with. 

Moreover, owning or transporting a vaporizer could be interpreted as possession of a prohibited item, especially at customs checkpoints or in public areas.
